Background

Land and housing right (LHR) issues represent a complex challenge for the Government of Timor-Leste (GoTL) and communities affected by unresolved land injustices from the colonial period to the present. Different past land regimes have resulted in a lack of clarity on rights to land. Currently there is no effective land law or policy. This, combined with a high reliance on agriculture, a lack of cooperation and collaboration between the State and traditional customary systems and a lack of resources and support for mediation and conflict resolution means that such disputes are a significant conflict trigger. Development is placing additional pressure on land, for example with government projects to improve infrastructure such as roads and projects related to resource extraction. This situation is exacerbated by a lack of understanding by, and access to services for, communities affected by land disputes. Housing access represents an additional layer of conflict within the broader land rights sector. Many people live in housing which is of poor quality or for which they do not have title.
